FIR can be cancelled even after filing charge sheet

The bench said that the High Court could hear the petition seeking quashing of the FIR. Even if the charge sheet has been filed pending the pendency of this petition, it can be heard.

In an important judgment, the Supreme Court has ruled that even after the chargesheet is filed, the accused can petition the High Court under section 482 of CrPC for quashing of the FIR.

Till now the law is that when a charge sheet is filed in a criminal case, the petition for quashing of FIR under section 482 is not acceptable, but this decision of the court has brought a big change in the position of criminal jurisprudence in favor of the accused.

A bench of Justices SA Bobde and L Nageswara Rao, while delivering the verdict, observed that it would be unfair to hold that proceedings against a person can be interfered with at the stage of FIR itself.

The Supreme Court held that the High Court can consider a petition filed under Section 482 CrPC seeking quashing of the FIR, even if the charge sheet is filed pending that petition.

There is nothing in the wording of this section which prohibits the exercise of the power of the court, the abuse of the process of the court or the miscarriage of justice only up to the stage of the FIR. It is a principle of law that the High Court, when the discharge application 2 (2011) 7 SCC 59 7 is pending before the trial court, can still exercise its jurisdiction under section 482 of Cr.PC.

In fact, it would be wrong to hold that the initiation of proceedings against a person can be interfered with only up to the stage of FIR, but not thereafter, especially when the charges have been converted into a charge sheet. On the contrary, it can be said that if after the FIR the case has reached the stage of chargesheet, then the abuse of process that leads to the FIR increases. This power has been provided in the criminal procedure to prevent the abuse of the power of any court.

The bench said that the High Court could hear the petition seeking quashing of the FIR. Even if the charge sheet has been filed pending the pendency of this petition, it can be heard.

The misuse will increase after the chargesheet –

The court said in the judgment that there is nowhere in section 482, in which the court has to be restricted only at the stage of FIR to prevent the misuse of law or injustice. It is an established principle of law that the High Court can exercise jurisdiction under section 482. Even the High Court can continue this proceedings pending the discharge application in the trial court.

The court said that it would be unfair to assume that the charge sheet has been filed against the accused and now the petition for quashing of his report cannot be entertained. On the contrary, the misuse of process due to FIR will be further aggravated when it gets converted into charge sheet after investigation. There is no doubt that the power to prevent injustice and abuse of process has been given to every court.

No Offence is proved-

Giving this decision, the Supreme Court said in the case against Anand Mohta that this case is of civil nature, no offense is proved in it. We hold that the siphoning off of the security amount of one crore rupees by the accused is purely a civil matter. We are also seeing that in this case the complainant did not make any other effort to recover this amount except by registering an FIR. It is clear that this prosecution has been made malicious, unsustainable and with the intention to harass the accused.

What is the matter-

Anand Kumar Mohta had contracted the builder to develop a property, but it was found in the bylaws that the property cannot be made a skyscraper, as it is in the Lutyens’ Zone. After this he wrote to the builder that he did not want the property to be developed, but he did not return the security amount of one crore rupees taken from the builder.

The builder lodged an FIR. Mohta went to the Delhi High Court to get it quashed, but the court said that preliminary inquiry was going on in the matter and dismissed the petition. After this he came to the Supreme Court, but by then the police had filed a charge sheet. It was said in the court that the petition for quashing of the FIR cannot be heard after the chargesheet is filed.
