IT Act Cases are being registered despite the scrapping of Section 66-A of the IT Act, the Supreme Court expressed concern

The Supreme Court on 06-09-2022 expressed concern that even after its decision to remove Section 66-A of the IT Act, cases have been registered in some states. Despite this, a large number of cases are being registered under this section all over the country.

He said, ‘The Supreme Court has also issued a notice and despite this, the registration of the case is a serious matter. Will the Supreme Court’s decision also not be implemented?’

The petitioner said that after the Supreme Court’s decision in this regard, 16 cases were registered in Jammu and Kashmir, 40 in Jharkhand and 113 in Madhya Pradesh. should be included in the case

The Supreme Court considered the matter serious that even after the verdict, some states are filing cases under 66-A. Talk to their chief secretary and work on ending those cases. Along with this, the top court gave 3 weeks to the central government to complete this process. The matter will be next after 21 days.

Under Section 66-A of the IT Act, there was a provision that a person can be arrested for posting objectionable, provocative or inciting material on social media, but the top court has ruled this law for speaking under Article 19 I1 IA of the Constitution. and was repealed as against the fundamental right to freedom of expression.

सुप्रीम कोर्ट ने मंगलवार को इस बात पर चिंता जताई कि IT Act की धारा 66-A को हटाने के उसके फैसले के बाद भी कुछ राज्यों में केस दर्ज किये गए हैं I याचिकाकर्ता के वकील ने कहा कि IT Act की धारा 66-A के हटाने के बावजूद भी इस सेक्शन के अंतर्गत बड़ी संख्या में पूरे देश में मुकदमे दर्ज हो रहे हैं I उन्होंने कहा, ‘सुप्रीम कोर्ट नोटिस भी जारी कर चुका है और इसके बावजूद केस दर्ज होना गंभीर मामला है I क्या सुप्रीम कोर्ट के फैसले को भी लागू नहीं किया जायेगा I’

याचिकाकर्ता ने कहा कि इस संबंध में सुप्रीम कोर्ट के फैसले के बाद जम्मू-कश्मीर में 16 केस दर्ज हुए, जबकि झारखंड में 40 और मध्य प्रदेश में 113 केस दर्ज किए गए हैं I याचिकाकर्ता की तरफ से मांग की गई कि अटॉर्नी जनरल को भी इस मामले में शामिल किया जाना चाहिए I

सुप्रीम कोर्ट ने इस मामले को गंभीर माना कि फैसला आने के बाद भी कुछ राज्य 66-A के तहत मुकदमा दर्ज कर रहे हैं I सुप्रीम कोर्ट ने केंद्र सरकार के वकील को कहा है कि जिन राज्यों ने फैसले के बाद भी मुकदमे दर्ज किये हैं, उनके मुख्य सचिव से बात करें और उन मुकदमों को खत्म करने पर काम करें I इसके साथ ही शीर्ष न्यायालय ने इस प्रकिया को पूरा करने के लिए केंद्र सरकार को 3 हफ्ते का समय दिया I मामले की अगली 21 दिनों के बाद होगी I

IT Act की धारा 66-A के अंतर्गत यह प्रावधान था कि सोशल मीडिया पर आपत्तिजनक, उत्तेजक या भावनाएं भड़काने वाली सामग्री डालने पर व्यक्ति को गिरफ्तारी किया जा सकता है, लेकिन शीर्ष अदालत ने इस कानून को संविधान के अनुच्छेद 19 I1 Iए के तहत बोलने और अभिव्यक्ति की आजादी के मौलिक अधिकार के खिलाफ बताकर निरस्त कर दिया था I
