Marriage Registration is not valid without marriage ceremony, marriage certificate will be considered fake – Madras High Court

The High Court said that it is the duty of the registering officer to verify whether the marriage has actually taken place or not before registering the marriage. The court said that the marriage ceremony is necessary.

Madras High Court on Marriage Certificate – The Madras High Court made a special comment regarding the marriage certificate. The High Court said that marriage registration without marriage ceremony would be invalid and the marriage certificate would be considered as Fake Marriage Certificate.

The High Court said that it is the duty of the registering officer of the marriage to check whether the marriage has actually taken place or not before registering the marriage.

Compulsory for couples to go through marriage ceremonies

Madras High Court Justice R. Vijayakumar said, “It is mandatory for couples to go through the marriage ceremonies that are applicable to their respective religions.

Only after marriage in accordance with the relevant personal laws can the said marriage be registered under the Act (Tamil Nadu Marriage Registration Act, 2009). Without going through the marriage ceremony, a marriage cannot be registered under the Act.”

‘जोड़ों के लिए विवाह समारोहों से गुजरना अनिवार्य’

Marriage registration मद्रास हाईकोर्ट Madras High Court के न्यायमूर्ति आर. विजयकुमार ने कहा, “जोड़ों के लिए विवाह के उन समारोहों से गुजरना अनिवार्य है जो उनके संबंधित धर्म पर लागू होते हैं. संबंधित व्यक्तिगत कानूनों के अनुसार विवाह के बाद ही उक्त विवाह अधिनियम (तमिलनाडु विवाह पंजीकरण अधिनियम, 2009) के तहत पंजीकृत किया जा सकता है. विवाह समारोह से गुजरे बिना, अधिनियम के तहत विवाह को पंजीकृत नहीं किया जा सकता है.”

उन्होंने 2015 की एक मुस्लिम महिला की दायर याचिका पर सुनवाई करते हुए यह टिप्पणी की, जिसमें उसके चचेरे भाई के साथ उसकी शादी को इस आधार पर रद्द करने की मांग की गई थी कि उसने उसके माता-पिता को जान से मारने की धमकी देकर जबरन शादी की थी. महिला ने दावा किया कि उसके और उसके चचेरे भाई के बीच इस्लामी परंपरा के अनुसार कोई विवाह समारोह आयोजित नहीं किया गया था.

‘…तो माना जायेगा विवाह पत्र फर्जी’

न्यायाधीश ने कहा कि पंजीकरण प्राधिकारी का यह कर्तव्य है कि वह यह सत्यापित करे कि विवाह को पंजीकृत करने से पहले जोड़ों ने अपने संबंधित व्यक्तिगत कानूनों के अनुसार विवाह समारोह किया है या नहीं. उन्होंने कहा, “विवाह के तथ्य को सत्यापित किए बिना पंजीकरण प्राधिकारी जोड़ों के प्रस्तुत आवेदन के आधार पर विवाह का रजिस्ट्रेशन नहीं कर सकता है. यदि कोई विवाह प्रमाण पत्र बिना किसी विवाह समारोह से पहले जारी किया जाता है तो इसे केवल फर्जी विवाह प्रमाण पत्र माना जा सकता है.”
